Johnson's mother and her sisters are currently raising Ava, whom Johnson adopted from Kazakhstan in 2007. But Tequila, who says she was engaged to Johnson at the time of her death, says she intends to file papers in court to adopt the three-year-old.
Johnson's mother Sale took custody of Ava in 2009 out of concern for the toddler's safety amidst Johnson's personal strife, including an arrest and a bout at rehab for drug addiction.
Tequila asserts that Johnson's death was an accident and that the heiress never wanted her mother to raise the child.
"Her last wish was to have Ava, have me have Ava," Tequila told Extra. "I know for a fact it was not suicide because Casey was so excited for our life together. I know it was an accident because she did have a sleeping problem."
