The custody saga continues as "former" lesbian Lisa Miller of Vermont is accused of running away with her seven-year-old daughter, Isabella, to avoid sharing custody with her former partner, Janet Jenkins.
As of Wednesday, a Bedford County judge has decided not to press charges against Miller, reports WSET News.
Although Jenkins did not appear in court for the judge's ruling, the American Civil Liberties Union did. She asked the judge to issue new charges of criminal contempt and find Miller's whereabouts, neither of which happened.
"It's not the result I hoped for," Jenkins' Attorney Rebecca Glenberg said.
According to the Advocate, a judge says he can't hold Miller in contempt if court because Miller was never notified of the pending charges being that she was nowhere to be found.
Miller and Jenkins were joined in a Vermont civil union in 2000. Isabella was born to Miller through artificial insemination in 2002. The couple broke up in 2003, and Miller moved to Virginia, became an evangelical Christian and soon after, "renounced" her homosexuality.
A Vermont judge had ruled that Miller was to transfer custody of the child to Jenkins on January 1st to the woman's former lesbian partner, but it never happened.
