Massachusetts Attorney General Martha Coakley is asking a federal judge to overturn the Defense of Marriage Act because it interferes with Mass’ rights to define marriage, the Associated Press is reporting.
Coakley, who lost her Senate seat last fall to Tea Party poster boy Scott Brown, argues that the federal law, which defines marriage as between a man and a woman, unlawfully interferes with the sovereign authority of Massachusetts to regulate marriage in their state.
Many Republicans should have a hard time defending against Coakley’s claim as one of the fundamental beliefs of the party is state’s rights. Repubs historically believe in smaller government at the Federal level and more responsibility at the State level.
Coakley is also arguing that the law requires the state to treat married same-sex couples differently from straight couples when it comes to Federal income tax and benefits.
