Elena Kagan Calls DADT Unjust

Supreme Court nominee Elena Kagan didn’t miss a beat when Sen. Jeff Sessions demanded to know her position on “don’t ask, don’t tell” Tuesday morning during day 2 of her confirmation hearing. Kagan said she felt the ban on open service by gays and lesbians in the military "was unjust. I believed it then and I believe it now."

Supreme Court nominee Elena Kagan didn’t miss a beat when Sen. Jeff Sessions demanded to know her position on “don’t ask, don’t tell” Tuesday morning during day 2 of her confirmation hearing.

Kagan said she felt the ban on open service by gays and lesbians in the military "was unjust. I believed it then and I believe it now."

Sessions confronted Kagan during the hearing with a string of questions on the restrictions on military recruiting at Harvard when she was the dean of the law school because she believed the "don't ask don't tell" policy violated the school's antidiscrimination code.
