Espinoza of Long Beach, Calif., claims that she was unaware that she was pregnant. When she gave birth, KTLA reports that Espinoza panicked and went to her mother, Sonia Hernandez, who called 911 and falsely reported that she discovered an abandoned infant at a nearby gas station.
Hernandez told police, and later reporters on Monday night, that she discovered the girl wrapped in a blanket, and placed in two plastic bags.
In Monday night's KTLA report on the baby being found at the gas station, Hernandez even told reporters that Espinoza urged her to leave the baby behind instead of reporting the infant to local authorities.
Long Beach detectives said Espinoza "apparently felt unfit to continue to care for the child because she felt she was more interested in protecting her relationship with another woman."
The child is now under observation at St. Mary's Medical Center in Long Beach.
California's Safe Surrender Baby law, enacted in 2006, ensures that any person with a baby less than 72 hours old can surrender their child to a hospital or fire house, no questions asked.
